Our club rules
  1. Terms & Conditions

The following terms bl conditions govern the rights and obligations of Fitness First LLC Health Clubs operated as ('Fitness First') and members thereof.

  1. Fitness First Clubs in the UAE 'The Club' and/or 'Fitness First'

The Club is operated by Fitness First LLC ('The Company') whose principalobjectiveis to provide health and leisure facilities for Club Members and their Guests. The Home Club is where a member joins. The Company has appointed a Management team ('The Management') who are responsible for the operation of the Club.

 

  1. The Company reserves the rights to introduce and operate any access control system which must be followed by the Club Members, Guest and Visitors.

 

  1. The Company reserves the right to introduce or make any changes (discontinue) to any promotions. initiatives, offerings, propositions and options as part at business strategy as they see fit and implement or make changes to these accordingly.

 

  1. Membership

 

a)    Memberships and assigned club access codes are personal to the member and are non-assignable, non-shareable, non-transferable and non-refundable. In exceptional circumstances a transfer will be considered at the discretion of the Club's General Manager; however, an administration fee would be applicable. The Company may assign the benefits at these agreements to any person. firm or company at any time without notice to the member.

b)    All new memberships are subject to the approval of the Management. The Management reserves the right to reject an application for membership at the Club tor any reason whatsoever.

c)    Upon acceptance, the member will have to download and register on the member application and the member shall be entitled to all the rights and privileges under the class ot membership purchased

d)    Any member wishing to enter the Club without a valid and active membership via member application and corresponding club access code, will only be admitted at the absolute discretion of the Management. Club access codes are personaland must only be used by the assigned member.

e)   Fitness First membership entitlesa member to use any FF club having the same status of membership as the membership taken, or any category below.

All Access: allows members to access to All Fitness First clubs in the Middle East, as well as partnered Fitness First clubs located Internationally.

Titanium: allows members to access to All Fitness First clubs in the Middle East, as

well as partnered Fitness First clubs located Internationally excluding All Access clubs.

Platinum: allows member to access to All Fitness First clubs in the Middle East as well as partnered Fitness First clubs located Internationally excluding Titanium and All Access clubs.

Home:allows the members to use one club at their choice only

 

t) For any monthly membership you must complete the minimum term before any membership adjustments can be made

g)   Memberships are available to individuals who are a minimum at 16 years at age. Any applicant below 16 and above 14 years of age must produce a letter of consent by the parent/guardian, however all visits must be accompanied by the parent/guardian or the junior member will be required to purchase PT and only train in the club with a Personal Trainer.

h)   Where membership option indicates specific age group or gender, entitling access to all or specific facilities or services, It is the member or parent/guardian responsibility to familiarize themselves with the Ts&Cs before purchasing such membership.

i)    Any changes to your membership must be applied via official channels and authorised staff, any other forms of change request will not be accepted.

 

j)   Membership Fees

 

i.i  All members shall pay an initial Start Up Fee as per the rate applicable at that time, these are non-refundable, including upon resignation or termination, and shall become immediately due upon being accepted as a member. Start Up Fees are subject to change without notice.

j.ii Start Up fees and Membership fees are non-refundable upon resignation or termination for any reason whatsoever.

i.iii    The Management reserves the right to periodically review their prices. charges and fees and implement these accordingly.

i.iv   Monthly subscription is payable on the 1st of every month through credit card arrangements as indicated during joining or update process via card tokenization.

i.v   Failure to use the Club or non-usage of the Club's facilities for any reason whatsoeverdoes not eliminate the obligation to pay all the subscriptions on time, nor grants a refund.

i.vi   If for any reason your credit card becomes inactive. it is your responsibility to provide the club with new credit card details immediately. For payments that default on the 1st of the month they will be subsequently charged until the payment is collected. In such cases access to the club will be denied until the outstanding fees are paid. A 'late payment fee' of AED 50 + applicable taxes will be charged for all payments received after the15th of the month. The collection dates may change in the future.

i.vii   Dues not challenged within 14 days of processing at the Club will be non-refundable thereafter.

i.viii  The Management will cancel any membership on which fees are unpaid for three months. thereafter The Management also has the right to continue to attempt to charge tor these dues accordingly. Legal action will be taken to recover any outstanding dues from the member. You may not rejoin any of our Clubs until the outstanding amount is paid

i.ix   Any lapse in membership will require the member to rejoin at the prevailing rates including any applicable Start Up Fee

i.x   All amounts payable under this Agreement shall be exclusive of value added tax ("VAT') or similar indirect tax. Where VAT is payable under this Agreement, the consideration for the supply of goods/services shall be increased by an amount equal to the amount of VAT, applicable at the prevailing rate at the time such supply is made. Payment of VAT. as applicable under law, is a prerequisite under this Agreement.

 

k)   Freezing Membership

I)   Members can apply to 'freeze' their membership for the future, if approved a freeze fee of                  + applicable taxes per month will be applicable. In all cases the Club has the right to ask for supporting documentation before accepting the freeze. To freeze a membership a member must complete a form at their Home Club min 48hrs prior to the requested start date of the freeze. A membership cannot be frozen during the 1st month of membership,The freeze period must be tor a duration of not less than 1 month. however more flexible options might be available at the time of request. A maximum of 3 months in any 12 is allowed and the freeze may not be used in respect of the notice period for cancellation of membership. Members cannot use the Club, its services, or facilities during this period. Membership freeze on1 month subscription is not permitted.

I)   Termination of Membership

 

I)   Members applying for 'Termination' from the Club must complete a form with the General Manager prior to the 25th of the current month, for the request to take effect the following month.

II)   All monthly paid memberships are open ended; therefore, we will continue to deduct membership dues until a request to cancel is received from the member. Monthly memberships do not automatically cancel after the initial minimum term indicated. Such requests must be made in writing to the Club's General Manager before the 25th of the month tor the next month to be considered as the last month of dues. The member shall obtain a confirmation in writing from the Club that the Termination has been applied

Ill) Cancellation of any upfront payment membership is not permitted, and the amount paid is non-refundable.In exceptional circumstances, a request to transfer the remaining balance of membership may be considered, and a new membership and commitment period may be required.

IV) Termination at a membership that has been frozen shall be subject to full monthly dues for the notice period. Freeze period is excluded from the minimum term.

 

5.  Physical Condition of Members

 

a)   The member warrants and represents that he/she is in good physical condition and that he/she knows of no medical or other reason why he/she is not capable of engaging in an active or passive exercise program and that such exercise would not be detrimental to his/her health, safety. comfort or physical condition.

b)   It is the member responsibility to update the club in writing with any information that might affect theirability to engage safely in physical activity in clubs and obtain physician written approval letter prior to commencing any type of physical exercise.

c)   The member shall not use any Club facilities whilst suffering from any infections or contagious illness, disease, or other ailment such as open cuts, abrasions, open sores or minor infection. where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.

d)   Members and theirguests exercise and use the facilities at their own risk and are advised to consult their physician prior to commencing any type of physical exercise.

 

7.   Expulsion of Members

The management may terminate the membership of any member:

a)     Without notice and with immediate effect if a member's conduct, whether or not such conduct is the subject of complaint by another member or members, is such that in the reasonable opinion of the Management, it is harmful to the character and/or interests of the Club.

b)     Without notice and with immediate effect if The Company is of the opinion that the member shall have committed any breach of the 'Fitness First Club Rules' that the Club has in place.

c)     If a member is rude, aggressive or in any way disrespectful to another member or to any of the Fitness First employees, this includes foul/bad language.

d)     If any monthly membership fees or any other fees such as Personal Training etc. remain unpaid after the due date tor payment.

e)     Upon notice in writing, if the Company is of the opinion that the member is not a suitable individual tor continued membershipof the Club.

f)      If a member is found to have violated the privacy of any other member within the shower and the changing rooms or are caught in lewd or compromising actions. thisincludes ignoring or disrespecting the Club's 'No Nudity' policy in the changing room area.

g)   If a member is found to have violated the Fitness First Club Rules as interpreted by The Company.

 

A member whose membership is terminated by The Management shall forfeit all the privileges of membership with immediate effect without claim of any refund of his/her initial Start Up fee or Monthly membership dues, other than any monthly membership dues paid in advance. On termination of his/her membership the member must settle any outstanding debts.

 

8.   Guests and Visitors

 

a)   Members introducing guests shall ensure that their guests tallow the guest registration process and pay the current guest fee to obtain their guest access

b)   For security reasons, all guests and visitors are required to provide a photo ID such as Emirates ID or Passport/ Visa copy when visiting the clubs,A copy and/or ID number will be retained on record.

c)    A guest pass/guest access code that has been issued on a 'complimentary' basis must be used in line with the stated Ts&Cs.

d)   Members are not permitted to use a guest access code /guest pass to gain access to the Club or use any paid facilities without charge unless authorized by Management.

e)   Guests will have the same membership privileges as the member who introduced them and will be subject to the same Club Rules and limitations of liability as the member. It is the responsibility of the member introducing a guest to ensure that their guest complies with the Club Rules.

f)    The Management reservesthe right to exclude any guest from the Club without giving any reason tor doing so and change the charges levied for guest access from time to time

g)   Any guest of a member or a temporary visitor to the Club shall agree to abide by the Club Rules and the same limitation of liabilities for a member shall apply.

 

9.    Health and Safety

 

a)   All members are required to complete themandatory Getting You Started fitness session 1, before commencing their exercise program with one of the Club's Fitness Trainers. thereafter any further training sessions can be conducted.

b)   Members should be considerate of other members by using their workout towel when using any of the exercise stations and wipe down equipment clean.

c)    Members are requested to return all portable equipment after use, including free weights and dumbbells to the racks provided.

d)   Fitness Trainersare authorized to stop anyone from exercising if in their opinion the member/guest is exercising in a manner that may result in personal injury and or injury to others. Users must abide by the guidance of the Fitness Trainers and comply with all points clearly stated in the 'Gym Etiquette'.

e)   Mobile phones should not be used in any of the exercise areas and should be kept on silence in the lockers provided.

f)    Smoking is not permitted in any part of the Club.

g)   In the interest of health and hygiene, all Club users are requested to shower prior to entering the Sauna/Steam Room/Swimming Pool.

h)   Members or guests may not use the facilities of the Club whilst under the influence of alcohol. narcotics or other mood altering substances.

i)     Games or activities which are disturbing or dangerous to others are not permitted, Sound equipment, such as personal speakers or music players, are not permitted except with the use of headphones.

10.  Operating Hours

The Club's normal hours of operation are indicated at the Club entrance and notice board. The Management reserves the right to adjust the hours for the purpose of cleaning, decorating, repairs, and special private functions and holidays. The Management shall endeavor to give reasonable notice of any change in the hours of operation.

Last admission will be allowed one hour before closing and you are requested to leave the Club premises punctually at the time of closing.

 

11.  Dress Cade

 

All members and guests are required to wear proper gym attire when exercising and to dress modestly when working out, this applies in all areas of the gym including Swimming Pool/Sauna/Changing Are etc. Short workout tops that expose the midriff are not permitted. No torn clothes. jeans, denim shorts or beanie hats are permitted. Closed toe, non-marking, rubber soled sports shoes/footwear are required at all times in the gym and in the Group Exercise Studios, 'Croes' are not considered as a suitable workout shoe. Nudity is not permitted, and members are requested to use the private changing cubicles provided

 

12.  Club Facilities

 

a)   The Management accepts no responsibility for loss or damage to a member's personal belongings brought to the gym or kept in the lockers for any reason whatsoever.

b)   The use of mobile phones with camera features and/or any other types of visual recorders in all areas especially the changing rooms are strictly prohibited. Members breaching this rule will be handed over to the authorities to be dealt with accordingly.

c)    Certain complimentary drinks are provided to members tor consumption within the premises only. Members and guests are not allowed to bring their own toad and/or drinks into the Club

d)   The Management may from time to time show potential members or others around the Club and allow them to use the Club's facilities on a trial basis and reserves the right to do so.

 

13.  Getting Yau Started/ Personal Training

 

a)    Getting You Started sessions must be completed on or before the stated expiry date. Extension to this date requires authorization from the Fitness Manager.

b)    Personal Training can only be conducted by Fitness First employed trainersthat are qualified and certified.

c)    Personal Training sessions are book on the memberapplication and Attendance. or No Show ismarkedby the trainer, with a notification to the member confirming the outcome of the session. Personal Training Booking Policy applies.relevant paperwork to support the contract extension has been received.receipt are deemed valid.

d)    All sessions must be completed on or before the contract expiry date, any considered contract extension must be authorizedby the Fitness Manager after ensuring all relevant paperwork to support the contract extension has been received.

e)    Only Personal Training sessions purchased at Front Desk with an official Fitness First receipt are deemed valid.

f)     The Club reserves the right to provide a replacement qualified Personal Trainer in the event that the current trainer is not available (this will be at The Management's discretion).

g)    Notice of cancellation of PT sessions must be given at least 24 hours in advance of the scheduled appointment time.Sessions will be deemed used within 24 hours of the scheduled appointment. Failure to attend a scheduled PT session without notice will result in the session being fully charged.

h)    Personal Training must be conducted prior to expiry date and it is the client responsibility to ensure they book those accordingly with the trainer as well as manage their remaining session balance

i)     All PT sessions purchased are non-refundable and non-transferable.

 

14.  Group Exercise

 

a)    Member must book GX classes via Fitness First MENA member app In line with

b)    Members are not allowed to enter the studio once the class has started.

c)    Members are asked to refrain from using mobile phones in all classes

d)    Members can attend any class anytime, however back to back classes are discouraged to allow other members to enter.

e)    For hygiene reasons, members must use towels in all workout classes.

f)     Some Group Exercise classes are free of charge and some are part of paid proposition, The Company also reserves the right to apply fee in selected clubs where the charge or required credit purchase will be specified.

f)   Members must not use the GX studio nor GX audio systems unless permission has been granted from the Group Exercise Manager or General Manager.

g)  Any specialized coaching and training that take place on Fitness First club premises such as Swimming, Personal Training, Coaching or Squash, can only be conducted by Fitness First employed trainers or officially appointed third parties.

 

15.  Lockers

 

a)    Temporary lockers will be provided by The Club and must be cleared daily. Unclaimed properties will be kept by The Club for a period of 1 week after which The Management reserves the right to dispose of the items in any way it sees it. The Management does not take any responsibility tor the items kept in the lockers.

b)    Please do not keep any money or valuables in your locker. Fitness First cannot be held responsible for any loss or damages

c)    If a member loses or damages a key/lock, he/she will be responsible to pay a fee to replace the key and/or lockset if necessary.

d)    Private lockers maybe available for hire at the prevailing monthly fee which may change. Lockers are non-transferable.

e)    Extension of locker rental must be paid at the Front Desk a week before expiry. A week after the locker expiry date, The Management reserves the right to empty the locker and deal with the contents accordingly as they see fit.

16.  Others

 

a)    Soliciting and selling private Personal Training sessions or merchandise of any type to any member is prohibited and shall result in immediate termination of the member concerned

b)    Specific Childcare Policy applies.

c)    The Management reserves the right to use any individual or group photographs of members and/or guests for press or promotional purposes.

d)    All members must abide by The Club Rules which may be amended and/or added to from time to time at The Management's Discretion and any Ts&Cs or Policiesthat apply to specific products or services.

e)    Failure by The Management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.

f)     All brandings. designs, logos and Club interiors tallow the Fitness First Brand Manual. Members and/or guests are not allowed to photograph or copy any Club interior designs, promotional materials, tag lines, themes or concepts. Fitness First reserves the right to proceed with legal action to any member caught distributing, sharing or supplying such contents to any third-party vendor or competitor.

g)  Terms and Conditions apply to all member and non-member promotions and must be followed If one has agreed to take part in the promotion. it is your responsibility to familiarize yourself with the Ts&Cs before participating in promotions. Full Fitness Fist Club Rules apply to this membership and are listed in this application.

h)    If you are eligible for a !-month free promotion, the tallowing Ts&Cs apply:

h.i)         You must bring the voucher/voucher code to Front of House to be eligible tor promotion redemption.

h.ii)  You must follow the redemption rules as stated in the promotion Ts&Cs.

h.iii)  Not redeemable for cash & not exchangeable.

h.iv)  One per person.

h.v)   Lost expired or redeemed vouchers will not be replaced, and only original voucher must be handed in to reception.

h.vi)  The earliest the voucher can be redeemed is in the last month of member minimum term that excludes any freeze period.

h.vii)  Valid at Fitness First Middle East. Restrictionsmay apply.

h.viii) Membership must be valid/active and clear of arrears at the time of using their voucher

h.ix)   Voucher allows entry to the existing membership tier only.

h.x)   Voucher redemption remains subject to The Management discretion

i)     Where a member or non-member decided to take part in any promotion, additional Ts&Cs specified accordingly must be tallowed.

j)     Only services and products purchased officially at Fitness First Front Desk and where an official Fitness First receipt is issued are deemed valid.

k)    We reserve the right to install and operate alarm, video surveillance and monitoring systems on our premises.

I) Fitness First reserves the rights to contact you via telephone. email, social media, or various forms of messaging services regarding promotional matters and related to your membership. In addition, by entering into this agreement, you expressly consent to receiving promotions and other information as The Company sees fit.

17. Limitatian of Liability

 

a)    In consideration of The Management accepting his/her application for membership of the Club and tor him/her becoming and remaining a member of the Club, the member agrees that:

a.i)    Fitness First LLC or its subsidiaries accepts no responsibility for

loss, for damage to members' or their guests' properties of. tor death or injuries sustained while on the premises. Members and their guests agree that no claims will be made against the Company, Fitness First LLC, The Management or

staff for any reason whatsoever.

a.ii)    Fitness First, its associated companies. employees or agents shall not be responsible tor any claims, demands. injuries. damages or actions for negligence arising on account of death or due to injury. loss, damage or theft to member's personal property arising out of or in connection with the use by a member of any of the services, facilities on the premises of Fitness First LLC The

member hereby holds The Company. Fitness First LLC, its associated companies, employees and agents harmless from all claims which may be brought against them by or on a member's behalf for any such injuries or claims aforesaid.

a.iii)   Any advance payments towards fitness classes or any other payable activates. products or services will not be refundable or transferable

a.iv)   Any services, Club surrounding areas or facilities that are not under the direct management of Fitness First do not fall under Fitness First responsibility and The Company accepts no liability tor any injury or loss incurred through use of these facilities.
